Terms of Service

1. Who we are

The Neurobird Search API (the "Service") is operated by Neurobird ("we", "us"). Contact: [email protected]. By creating an API key or calling the Service you agree to these terms. If you do not agree, do not use the Service.

2. What the Service does

The Service is a programmatic web search and content extraction API. It queries public web search engines, retrieves publicly accessible web pages, extracts and ranks their content, and returns results, page text and optional generated answers over HTTP and over the Model Context Protocol.

The Service returns material published by third parties. We do not own that material, do not warrant its accuracy, and are not responsible for it. You are responsible for how you use, store and redistribute anything the Service returns, including complying with the rights of the original publishers.

3. Accounts and API keys

API keys are issued without a signup form. You are responsible for keeping your key secret and for all usage recorded against it. Tell us at once if you believe a key has been exposed and we will replace it.

4. Credits, purchases and the seller of record

Usage is metered in credits. Each key receives a free monthly allowance. Additional credits are bought as one time packs. There is no subscription and no recurring charge.

Purchased credits do not expire. Free monthly credits are granted per calendar month and are not carried over.

Payments are processed by NOWPayments, our payment provider. We never receive or store your payment credentials. The provider's own terms apply to the payment transaction in addition to these terms.

We may add further payment providers, including card checkout through a Merchant of Record. Where a Merchant of Record is used, that provider becomes the seller of record for the purchase and is responsible for collecting and remitting applicable sales tax, VAT or GST. The provider in use at the time of your purchase is shown at checkout and on your receipt.

5. Refunds

You may request a refund of unused credits within 14 days of purchase, for any reason. Write to [email protected] with your request ID or the email used at checkout.

Where part of a pack has been consumed, we refund the unused portion at the price paid per credit. Credits consumed have been delivered and are not refundable.

If the Service is materially unavailable or fails to deliver results you were charged for, tell us and we will credit or refund the affected requests regardless of the 14 day window. Refunds are issued through the payment provider used for the original purchase and are returned to the original payment method.

6. Acceptable use

Your use of the Service is additionally governed by our Acceptable Use Policy, which forms part of these terms. In short: do not use the Service to break the law, to infringe anyone's rights, to attack or overload third party sites, or to build the categories of product listed in that policy.

We may suspend or terminate a key that breaches these terms or the Acceptable Use Policy. Where suspension is not the result of a breach by you, we refund unused credits.

7. Availability and limits

The Service is provided without a formal uptime guarantee. It depends on third party search engines and on the availability of the web pages it reads, and those upstreams can be slow, rate limited or unavailable in ways we do not control. We publish per request timing data and a health endpoint so you can see the state of the Service for yourself.

Rate limits apply per key and are published in the API reference. We may change limits to protect the Service, and will not reduce them for a paying key without notice.

8. Your content and our data use

We do not claim ownership of your queries. We process and retain queries and usage metadata as described in our Privacy Policy, for the purposes of operating, metering, securing and debugging the Service.

9. Warranties and liability

The Service is provided "as is". To the extent permitted by law we exclude implied warranties, including fitness for a particular purpose. We do not warrant that results are complete, accurate, current or free of third party rights.

To the extent permitted by law, our total liability arising from the Service is limited to the amount you paid us in the three months before the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits or lost data.

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

10. Changes

We may update these terms. Material changes will be posted here with a new date, and where they affect paid credits we will give notice by email to the address on the purchase before they take effect.

11. Governing law

These terms are governed by Austrian law, without prejudice to mandatory consumer protection rules of your country of residence. Disputes are subject to the competent courts of Austria, again without prejudice to any mandatory consumer forum available to you.
